December 20, 2016–On the 10-year anniversary of the Postal Accountability and Enhancement Act (PAEA) of 2006, the Postal Regulatory Commission (PRC) will begin its review. It will focus on whether the pricing regulatory structure is meeting the objectives of the law, taking into account it the law’s factors. The PRC will announce on December 20, 2016, a 90-day comment period during which interested parties will be invited to submit their comments. The PRC will define the nine objectives in PAEA and propose measurement systems for each. After the 90-day comment period, the PRC will deliberate internally. In early fall 2017, we expect the PRC to issue an order that will say the system is either meeting the objectives or not. If not, the PRC is expected to propose changes it deems appropriate to meet the objectives. The PRC will then start a more traditional notice and comment rule-making that we expect to extend well into 2018 before a final ruling. Many expect parties to appeal PRC rulings in the U.S. Court of Appeals for the D.C. Circuit. The 10-year regulatory review will consume the attention of the U.S. Postal community for some time to come.
